1. Agreement
By creating an account, placing an order or using the NS5Hosting website, control panel or servers (the "Services"), you agree to these Terms, our Acceptable Use Policy, our Privacy Policy and our Refund & Cancellation Policy. If you don't agree, please don't use the Services.
2. Your account
You must give accurate information and keep your login details secure. You are responsible for everything done through your account, including by sub-users you invite. You must be at least 13 years old, and if you are under the age of majority where you live, a parent or guardian must agree to these Terms for you.
3. The Services
We provide game server hosting with the resources (RAM, storage and CPU share) shown at checkout. We work hard to keep everything online, but we don't guarantee the Services will be uninterrupted or error-free. We may carry out maintenance, which we'll try to announce in advance on our Discord where possible.
You are responsible for the content on your server and for keeping your own copies of important data. Backups are a convenience tool, not a guarantee.
4. Billing
Plans are billed monthly in advance through Stripe or from account credit. If a payment fails, your server may be suspended until it's paid, and servers that stay unpaid may be deleted along with their data. Prices may change; we'll give notice before a change affects an existing plan.
5. Free trials
Free trials are limited to one per person or household. We may cancel trials that look like abuse, such as multiple accounts. When a trial ends, the server is paused until you pay.
6. Acceptable use
You must follow our Acceptable Use Policy. We may suspend or terminate Services that break it, in serious cases without notice or refund.
7. Games and third-party software
Games, mods and plugins belong to their owners. You're responsible for following their licences and terms (for example Minecraft's EULA). We're not affiliated with any game publisher.
8. Cancelling and termination
You can stop renewing at any time. We may suspend or end your account if you break these Terms, don't pay, or if we're required to by law. After termination, your server data may be deleted.
9. Liability
To the extent the law allows, the Services are provided "as is", and our total liability for any claim is limited to the amount you paid us in the three months before it. We aren't liable for indirect losses such as lost data, profits or goodwill. Nothing here limits rights you have under consumer law that can't be excluded.
10. Changes to these Terms
We may update these Terms. If we make important changes we'll let you know through the panel or by email. Continuing to use the Services after changes take effect means you accept them.
